GRAHAM, Wash. — A federal appeals court ruled that a lawsuit against the the Washington State Department of Social and Health Services, brought by the parents of the missing Susan Cox Powell can go forward.
KSTU-TV reports a lower court had dismissed Chuck and Judy Cox’s lawsuit against the DSHS after Josh Powell, who was suspected in his wife’s disappearance, killed their two kids and himself in Graham in 2012.
The Coxes were fighting for custody of their grandchildren when Josh locked a social worker out of his house during a supervised visit before attacking the young boys with an ax and blowing the house up, killing all three of them.
