SPOKANE, Wash. — A Lake Chelan water park’s federal lawsuit to overturn a state order preventing its re-opening has been tossed out.
Chelan County’s Safe Start Phase 1 status means large gathering places like water parks are forbidden from operating.
Slidewaters had sued L &I in Chelan County court saying Governor Inslee abused his power declaring a state of emergency.
The case was moved to Eastern District U.S. Court in Spokane and dismissed with prejudice Tuesday, meaning it cannot be brought again to the federal court.
The federal judge previously rejected the park’s request for a restraining order that would have allowed it to open.
Slidewaters nevertheless opened eight days later, on June 20 and is continuing to operate despite the threat of fines.
