BELLINGHAM, Wash. — With the changes in the state’s guidance on masking and distancing, there’s been some confusion about whether HIPAA — the federal Health Insurance Portability and Accountability Act — allows businesses to ask for proof of vaccination.
In a Facebook post, the Whatcom County Health Department says the short answer is yes.
HIPAA prohibits covered businesses such as health care providers, health plans and health care clearinghouses from disclosing your health information improperly, but does not apply to all businesses.
The Department said HIPAA does not prevent businesses from asking you for your health information.
Businesses also retain the right to require masks or ask for proof of vaccination.
