SEATTLE, Wash. (AP) — The lead attorney for over 40 victims of the deadly duck boat crash involving a Ferndale company’s tour bus three years ago said during opening statements of a civil lawsuit that the crash was not an unforeseeable accident.

Five college students died and dozens were injured when a duck boat swerved and crashed into an oncoming Bellair charter bus on Seattle’s Aurora Bridge after an axle broke.

The Seattle Times reports the lawsuit was filed on behalf of 42 people who were injured or killed, and names Ride the Ducks Seattle, Ride the Ducks International, the City of Seattle and the State of Washington as defendants.
