SEATTLE, Wash. (AP)  — A jury in Seattle has failed to return verdicts against a couple charged with assault during a protest of a conservative speaker at the University of Washington in January 2017.

The Seattle Times reports the King County Superior Court Judge declared a mistrial Tuesday in the trial of Elizabeth and Marc Hokoana.

Elizabeth Hokoana was charged with felony assault for shooting protester Joshua Dukes in the stomach while Marc Hokoana was charged with assault for firing pepper spray into the crowd.

Dukes refused to testify, saying he didn’t believe in or trust the U.S. justice system.

The jury foreman says the panel was divided on ideological lines.

Prosecutors say they’ll review the case before deciding whether to retry the couple.
