OLYMPIA, Wash. — The Washington State Supreme Court has overturned a law that was named after a Whatcom County woman injured by a drunk driver.
Hailey’s Law required law enforcement officers to impound cars that belonged to people arrested for DUI for 12 hours.
It came before the court on an appeal of a vehicle seizure following a DUI stop in Quincy last year.
The Seattle Times reports that the court unanimously agreed with the man who was arrested that the seizure of his vehicle was unconstitutional.
The state legislature passed the law in 2011.
It’s named after Hailey French who was badly injured by a drunk driver who had been arrested but returned to her car while still drunk and then crashed into her.
